OUR STORY

Family tradition

Our history began in 1949, when Mr. João de Borba established his law practice in Blumenau, then one of Brazil’s largest and most prosperous textile centers.

In a short time, he became one of the region’s most respected attorneys, building a distinguished clientele that included major companies such as Karsten S/A, HACO Etiquetas, Sulfabril S/A, Círculo S/A, Tecidos Carlos Renaux S/A, TEKA S/A, Gráfica 43 S/A, Cia. Hering, Artex S/A, Cremer S/A, among others.
Recognized for his expertise and dedication, Mr. de Borba was appointed by the Governor of Santa Catarina in 1967 to serve as a judge on the second tier of the State Court of Justice. During his tenure, he also served as a judge on the State Electoral Court of Justice.

After retiring from the judiciary in 1982, Mr. de Borba returned to private practice. In 2001, his grandson, Mr. João de Borba Neto, joined the firm following his graduation from law school.

Mr. de Borba Neto specializes in international trade, having completed his studies at Fundação Getúlio Vargas and further training at the Harris School of Public Policy and Finance at the University of Chicago, USA. He also participated in the Program for Young Attorneys at the Mission of Brazil to the WTO in Geneva, Switzerland, and the Trade Policy Program at the Embassy of Brazil in Washington, DC, USA. Additionally, he holds a postgraduate degree in Customs Law.

Today, Mr. de Borba Neto is an active member of the Committee on Customs Law of the State Bar Association of Santa Catarina (OAB/SC).

Currently, within the scope of the Santa Catarina OAB Section – OAB/SC, Dr. João de Borba Neto is a member of the Customs Law Commission. Within the scope of the OAB/SC Subsection of Itajaí, he is also a member of the Customs, Maritime and Port Law Commission.

He is also a member of the Foreign Trade Chamber of the Federation of Industries of the State of Santa Catarina – FIESC.

Our Areas of Practice

Customs Law

Operators engaged in the international market, whether exporting or importing goods or services, must comply with customs legislation and administrative regulations issued by the Federal Revenue Service and other regulatory agencies to avoid sanctions. Furthermore, the legislation provides benefits for exporters, aiming to reduce domestic production costs (such as the drawback regime), as well as other special customs regimes.

International Trade

International trade has undergone significant changes as countries and companies seek better agreements and opportunities. In this scenario, it is crucial for transactions to be monitored by an attorney who is well-versed in international market regulations and the interests of their clients. JBN Law provides legal assistance in trade defense matters, including antidumping, subsidies, and safeguards proceedings, representing foreign exporters/producers, domestic companies, or other stakeholders.

Litigation

With extensive experience, JBN Law assists clients during the pre-litigation phase to maximize their chances of success. The firm also handles cases where immediate action is required, such as urgent matters or situations where the client has been unexpectedly sued. Our litigation practice focuses on corporate disputes, contractual issues (domestic and international agreements), consumer matters, indemnities, banking disputes, and tax law. JBN Law has unique expertise in enforcement proceedings, asset recovery from debtors and intermediaries (“straw men”), and has achieved notable success in complex cases, including filing motions to disregard the corporate veil, autonomous probative actions, and other necessary measures to reach the assets of solvent debtors.

Migration

In recent years, Brazil has become an attractive destination for foreigners seeking to settle in the country, whether as employees, digital nomads, investors, or through marriage to a Brazilian national. JBN Law has extensive experience in filing visa and residence permit applications for individuals of all nationalities. Additionally, foreigners already residing in Brazil may also qualify for naturalization under certain conditions.

International Contracts

It is not uncommon for international commercial relationships to be conducted informally, without any written or signed agreement outlining the parties' rights and obligations. Disputes often arise when a right is infringed or an obligation is not fulfilled, leading to difficulties in proving the transaction and enforcing rights. In many cases, the absence of a written contract makes compliance virtually impossible. For this reason, international trade operators with their agreements protected by well-drafted contracts rarely face issues with noncompliance. JBN Law provides support from the negotiation phase, ensuring that contracts accurately reflect the terms agreed upon.
